1. Acceptance of Terms
By accessing or using the Ear Peace application, website, or related services (collectively, the “Service”) provided by Genesis Media Group LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.
2. Description of Service
Ear Peace is a therapeutic sound application that uses Notch Therapy and sound masking to support users who experience tinnitus. The Service includes a free diagnostic component and subscription-based premium features. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice where feasible.
3. Medical Disclaimer
Ear Peace is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The Service is for informational and supportive purposes only. Always consult a qualified healthcare professional (e.g., physician, audiologist) for medical advice, diagnosis, or treatment. Do not disregard professional medical advice or delay seeking it because of something you have used or read in connection with Ear Peace.
4. Subscriptions and Payments
Premium access may require a subscription. Payment and renewal are processed through the Apple App Store (or other platforms where the app is offered). You agree to the applicable store’s payment terms. Subscriptions may auto-renew unless cancelled before the renewal date. Refunds are subject to the platform’s policies (e.g., Apple’s refund policy). You may restore purchases through the app or the platform’s account settings.
5. User Conduct and Account
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not reverse-engineer, copy, resell, or misuse the Service, or use it in any way that could harm us or others. If you create an account, you are responsible for keeping your credentials secure and for all activity under your account.
6. Intellectual Property
The Service, including but not limited to text, graphics, logos, audio, and software, is owned or licensed by Genesis Media Group LLC and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
7. Limitation of Liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim all warranties, express or implied. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or use, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain limitations; in such cases our liability is limited to the fullest extent permitted by law.
8. Indemnification
You agree to indemnify and hold harmless Genesis Media Group LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service or your violation of these Terms or any law.
9. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming and the United States, without regard to conflict of law principles. Any dispute shall be resolved in the state or federal courts located in Wyoming. You may also have consumer rights under your local law that cannot be waived by contract.
10. Changes to Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Your continued use of the Service after changes constitutes acceptance. If you do not agree, you must stop using the Service.
